Job Description: 

The Legal Advocate will lead and implement the development of a legal support program for migrant agricultural workers in the Okanagan region of British Columbia. The Legal Advocate will provide legal information, referrals, summary advice and representation under the supervision of the Migrant Workers Centre’s Staff Lawyer in the areas of rights and responsibilities covered under the Workers Compensation Act, Employment Standards Act and Human Rights Code, among others. This intervention is a key aspect of a participatory action research project focused on evaluating the feasibility and effectiveness of a multidisciplinary support model for migrant agricultural workers. In this position, the successful candidate will also provide content and technical expertise to the research team in both data collection, analysis and service evaluation.

Skills and Qualities Required: 

• Completion of a relevant technical program or a university degree. Preference for an individual who has prior experience working as a Legal Advocate.
• A minimum of 5 years of related experience or an equivalent combination of education and experience.
• Knowledge and experience with legal advocacy service delivery
• Knowledge and experience working with immigrant populations and/or poorly housed individuals, and/or precariously employed individuals and/or entry-level agricultural workers
• Demonstrated ability to work both independently and within a team environment in a fast-paced research program
• Strong track-record providing legal advocacy and/or case support and/or navigation for historically (or currently) marginalized populations
• Working knowledge of computer applications for word processing and spreadsheets, systematic internet searches and data analysis
• Significant expertise in the legal rights and entitlements of migrant agricultural workers, and/or labour law, immigration law, and/or human rights and/or occupational health and safety
• Experience in prior research projects, especially program evaluation or community-based intervention studies a strong asset
• Excellent oral and written communication skills
• Fluency in both spoken and written Spanish and English preferred

Duties and Responsibilities: 

• Develop intake forms to assess and monitor individual migrant agricultural workers’ legal needs
• Conduct interviews with migrant agricultural workers, and assess and analyze legal problems on a case-by-case basis
• Provide legal information, referrals, summary advice, representation, system navigation, interpretation and accompaniment to help workers access various legal services and entitlements. This may include:
o Working as migrant agricultural workers’ authorized representative in cases where migrant agricultural workers require support filing or following up on work-related injuries with Worksafe BC
o Working with migrant agricultural workers in cases where migrant agricultural workers require support filing or following up on workplace issues with the Employment Standards Branch
o Working with migrant agricultural workers in cases where migrant agricultural workers require support filing or following up on workplace harassment issues, bullying, or discrimination with the Human Rights Tribunal
o Working with migrant agricultural workers in cases where migrant agricultural workers require support filing or following up on inadequate or unsanitary living condition with appropriate health authorities, inspectors, municipal governments, and other appropriate legal bodies
o Investigating and liaising with other relevant authorities who have the mandate or jurisdiction to protect the rights of migrant agricultural workers as requested by migrant agricultural workers
o Liaising with government officials, inspectors and employers in cases where informal mediation is preferred by migrant agricultural workers (e.g. employee does not wish to pursue formal legal channels, but requests support addressing workplace, housing, or health and safety concerns)
o Provide advocacy in healthcare settings when a migrant agricultural worker is injured at work and a workplace injury is suspected and a workplace injury may be reported to WorksafeBC
• Maintain detailed client files and protect the confidentiality of all client information
• Contribute to the development and implementation of the evaluative components of the research project
• Contribute to the development and implementation of a dissemination strategy for research findings and related resources developed by the research team.
• The legal advocate will perform other related duties as required.
